· On August 6, 2009, the Alabama Building Commission voted to adopt ABC Form C-8 Supplement,
“Supplement to the General Conditions of the Contract”, dated August 2009. The supplement provides
clarification on credits for overhead and profit on deductive change orders.
· Effective immediately, ABC Form C-8 Supplement is a mandatory form and shall be included in
the bid documents for all state-funded projects. ABC Form C-5, “Construction Contract”, dated
August 2001; ABC Form C-5 (State Version) “Construction Contract”, dated July 2006; and
ABC Form 9-A (PSCA Version), “Construction Contract”, dated August 2001, shall incorporate
the ABC Form C-8 Supplement in the Special Provisions as follows:
The Contract Documents are amended to include ABC Form C-8 Supplement,
dated August 2009, by reference.
· All construction contracts submitted to the Building Commission after September 1, 2009
shall include the Special Provision incorporating the ABC Form C-8 Supplement by reference.
· All Final Submittals submitted after September 1, 2009 shall include ABC Form C-8 Supplement,
when applicable, in the front-end documents.
